What are conciliators and what do they do?

 

Conciliators are natural persons with expertise in alternative dispute resolution (ADR). The conciliators must be registered in the Register of conciliators which is established according to the Regulation on the organization and functioning of the Alternative Dispute Resolution Entity in the non-banking financial field (SAL-FIN) - www.salfin.ro. The registration of the conciliators in the Register is done specifying for each conciliator the scientific titles held and the professional activity that defines him, the seniority and the field of competences in which he can solve the disputes.

 

SAL-Fin conciliators are appointed by consumers, they have at their disposal the Register of conciliators published on the official page www.salfin.ro. In the settlement procedure, the parties shall agree on the person of the conciliator or on the conciliation commission which shall consist of a conciliator appointed by the consumer, one appointed by the trader and one appointed by the Coordinating Board through a public algorithm. Please note that a consumer or trader cannot contact the conciliator directly to resolve a claim. The communications are made by SAL-Fin, and after the conciliator has received the file with the consumer's request, the communications, as well as any discussion related to conciliation, are made to all parties involved, including the representative of SAL-Fin within the Technical Secretariat;

The Institute of Financial Studies (ISF) offers you a professional training course for future conciliators, individuals who want to have the necessary knowledge and skills in the field of alternative dispute resolution or judicial settlement of disputes in this area. For consumption. Participants will also have a good general and specific understanding of financial sector legislation and consumer protection legislation, people who are independent and impartial.

 

At the end of the training program, graduates can become Conciliators and can register in the Register of Conciliators of SAL-FIN.

Who can be a conciliator?

 

The natural person who meets the following conditions can be a conciliator and registered in the Register of conciliators of SAL-FIN:

 

a) has full exercise capacity;

 

b) graduated long-term higher education, attested with a bachelor's degree;

 

c) has a good reputation;

 

d) has professional training and experience in alternative dispute resolution;

 

e) has adequate professional experience in the field in which the A.S.F. has competencies for the exercise of the responsibilities entrusted to him for at least 4 years or has carried out specific activities within the A.S.F .;

 

f) does not have facts registered in the fiscal and judicial record;

 

g) has not been definitively convicted for crimes against property, crimes of corruption, embezzlement, crimes of forgery of documents, tax evasion, crimes provided by Law no. 656/2002 for the prevention and sanctioning of money laundering, as well as for the establishment of measures to prevent and combat the financing of terrorism, republished, with subsequent amendments, or for other crimes, for which the law provides a prison sentence of 3 years or more;

 

h) has not been sanctioned by the A.S.F. in the last 3 years according to the incident legislation;

 

i) completed the application for enrollment prepared by the Coordination Board;

 

j) has been declared eligible by the Coordination Board.
